General Policies
All customers should become knowledgeable of our
policies. The Auction reserves the
right to change the policies as needed.
Lack of knowledge of policy requirements will not release dealers of
their obligations to abide by them.
These policies are established to help everyone transact
business with confidence.
- Only
licensed motor vehicle dealers and authorized representatives are eligible
to transact business at this Auction.
Dealers must be registered to buy or sell. Registered dealers are responsible for
all business transactions, including their representatives, under that
company name at West Central Auto Auction. No retail customers are allowed on Auction premises. Any dealer who abuses this policy could
be subject to loss of privileges.
ID Cards must be presented at counter and used at all times. An Iowa wholesalers license will not be
honored.
- To
apply for approval, dealers must furnish:
a. Completed dealer registration form
b. Copy of dealers’ license
c. Banking & business references
d. Driver’s license and social security card
e. Copy of current dealer bond
f. Insurance certificate
- Any
change in dealer registration info must be recorded with us.
- The
Auction reserves the right to interpret all policies and to decide all
issues of dispute and that decision shall be binding and final. Management reserves the right to reject
any motor vehicle which is offered for sale, void any transaction and
refuse to warrant the title to any vehicle sold.
- No one
under 18 is allowed on Auction premises, per our insurance.
- The
Auction does not guarantee or get involved in Factory Warranties.
- “Auction
reserves the right to refuse service to anyone.”
I.D. Cards
If the dealer of record wishes to authorize an individual to
act as his agent, the dealer must do so in writing. When the dealer extends this authorization, he shall be
responsible until such time as he informs the Auction, in writing, of
cancellation of this authorization. The
dealer shall be responsible for retrieving the Auto Auction identification card
or informing the Auction if he is unable to do so.
Upon acceptance of the plastic identification card issued by
the Auction, the person, corporation, or firm whose name is embossed on said
card, by retaining or using the card, agrees to pay for all purchases. This obligation shall end only after payment
of all purchases and the surrender of this card to the Auto Auction, or upon
the Auction’s receipt of the notice in writing that the card has been lost,
stolen or destroyed. The Auction
reserves the right to cancel or modify the identification card at any time and
to demand surrender of it. Admittance is allowed to only those persons holding
individually issued Auction ID cards.
Cards must be in the possession of the dealer while on auction
property. All dealers are responsible
for any transactions made by their authorized reps. No exceptions.
Lights
Ride & Drive
Green Light
It is the responsibility of both buyer and seller to watch
lights and listen for all announcements.
Each sale is video and audio taped for arbitration purposes.
Vehicles under 125,000 miles are subject to Sale Day
Guarantee.
The following items are subject to arbitration within one
hour after end of sale unless announced by the seller and sold under the yellow
light (Mechanical defect must exceed
$400 to repair):
- Vehicles
sold under the green light will be mechanically sound in all respects.
- Air
conditioning is guaranteed on up to 5 year-old vehicles (That compressor
clutch engages only). January 1st
date is used for this.
- Body
and paint repair damage on current year vehicles only must be announced
and will be deemed excessive only if three or more panels are
affected. Current year starts
January 1st.
- Air
bags and ABS must be present, operational or announced.
- Arbitration
rules exclude mechanical defects which can be fixed for $400 or less as
determined by the Auction’s arbitration Department. Cars are sold subject to any and all
visible defects.
- Rear
main oil leaks are the only oil leaks covered.
- We
will not arbitrate non-working power accessories, including but not
limited to, power door locks, radios, tape players, power windows or power
sunroofs. Additionally, we will
not arbitrate any vehicle needing less than $400 in repairs.
Blue
Light—Drive
Train Guarantee within $400 of repair
- Over
$1,001.00 in price and under 125,000 miles.
- Covers
crank, rods, block, transmission, differentials, drive axles.
- Valves,
noisy lifters, cv joints, wheel bearings, steering racks, not
arbitratable.
- Back
Lash and/or general wear in front wheel and 4 wheel drive vehicles are not
subject to arbitration.
Yellow
Light—“Caution—Listen
for Announced Condition”
- Selling
dealer must announce any item not to be subject to arbitration including
any unit in excess of 100,000 miles, any unit with an odometer not working
properly, and any unit with actual mileage different than the odometer
reading, or with a replaced odometer.
- Vehicles
announced “True Miles Unknown” must be sold “As-Is” and cannot be rejected
for any mechanical defects. Yellow
and Red light announcement.
- Selling
dealer must announce theft recovery, taxi, police, salvage, previous
salvage, frame, previous frame damage, flood, major damage history and
fire.
- Vehicle
with assigned serial numbers (VIN).
As-Is (Red Light)
·
Vehicles with over 125,000 miles.
·
Vehicles with “True Mileage Unknown” must be announced
and sold “As-Is”. These vehicles cannot
be rejected for any mechanical defect, except frame.
·
The Auction does not guarantee the year of any
recreational vehicles, antiques, motorcycles, reconstructed vehicles, boats,
boat motors, or trailers, and must be sold “As-Is” and frame is not guaranteed.
·
Any vehicle with an altered suspension system is sold
“As-Is”.
·
Taxi, police, previous salvage, frame, flood, theft
recovery, fire damaged vehicles and vehicles branded “major damage history”
must be announced and sold “As-Is”.
·
Vehicles sold for $500.00 or less are “As-Is” and
cannot be represented under a Personal Guarantee.
·
All vehicles sold under red light cannot be arbitrated
for any mechanical defect unless represented under a Personal Guarantee.
Any vehicle sold under the Red Light, is
sold on the spot in its present condition with NO ARBITRATION!! All diesel vehicles, boats, motorcycles,
ATVs, all types of trailers, RVs and trucks 2-ton and up must be sold under the
“As-Is” Red Light. Seller must provide
proper odometer statement as well as disclose any frame damage and/or
modifications. All vehicles sold $500.00
or less are sold assuming one or all of the following apply: Over 100,000 miles, TMU, broken odometer,
frame damage, changed engine, missing or altered exhaust with or without
catalytic converters, flood, salvage history, etc. regardless of announcements
by seller.
Personal
Guarantees
Personal Guarantees are an option under “Drive Train” or
“Ride & Drive”—you must choose one.
Vehicles must sell for $505.00 or more to qualify for a personal
guarantee.
Please note the seller must pay buy and sell fees if a
vehicle is arbitrated or returned under a personal guarantee.
Seven-Day
Guarantee
- Vehicles
sold with frame damage not announced by the seller are arbitratable for a
period of seven days from purchase starting on day of sale (this includes
all As-Is units and Outside Sales).
Frame damage from normal use, which does not affect the structural
integrity of the vehicle, are not grounds for arbitration, such
as: scratches, scrapes, jack or
lift marks, clamp marks, minor corner tie-down marks not resulting from
accidents and core support damage not affecting integrity.
- The
term possible frame is not acceptable at the auction and repaired
frame indicates the frame may not meet auction guarantees, unless
specifically guaranteed by the seller!
- Bumpers
and trailer hitches welded or drilled to the frame are not considered
frame damage.
- Lowered
vehicles are not subject to frame damage guarantees and must be
announced.
- Frame
damage policy used is the NAAA structural damage policy. Copies available in the arbitration
office.
Odometer Policy
Sellers must announce from auction block the following:
- If
odometer is over 100,000 miles.
- If
odometer is broken, repaired, or not in working order.
- If
seller has any knowledge that mileage on vehicle is different than mileage
on odometer.
- We
will not be involved in exempt mileage other than representation by a
seller or if there is proof of a rollback.
- Broken
speedometers are non-arbitratable as long as the odometer is actual and
functioning properly.
West Central Auto Auction assumes no responsibility nor
guarantees accuracy of odometer readings.
THE SELLER OF A VEHICLE WITH AN ODOMETER DISCREPANCY WILL BE
REQUIRED TO BUY BACK THE VEHICLE, REGARDLESS OF THE CIRCUMSTANCES, WITH
REIMBURSEMENT FOR TRANSPORTATION AND REASONABLE EXPENSES OR MAKE A PRICE
ADJUSTMENT SUITABLE TO THE BUYER.
Arbitration
If a vehicle is not properly represented, the buying dealer may
file a complaint within
1 hour after the end of the sale. All complaints and price adjustments must be
filed in the Arbitration office. The
arbitration staff will be as quick as possible, so please be patient.
In matters of interpretation of Auction policy, the
decision of Auction management will be final.
West Central Auto Auction will not be held responsible for
diagnostics performed or vehicle inspection on any outside sales.
General Arbitration
Policies
- No
arbitration after unit is paid for.
- Buyers
must arbitrate emission problems sale day only—except catalytic converter,
7 days.
- Buyers
are encouraged to inspect vehicles immediately.
- Vehicles
can be presented to arbitration only once and are limited to two
misrepresented items.
- Cars
sold “Ride & Drive” are guaranteed by seller against cracked blocks
for a period of twenty-four (24) hours after purchase.
- Any
salvage vehicle, salvage title or salvage history vehicle must be
represented as such.
- Sellers
will be charged all auction fees on vehicles arbitrated for
misrepresentation resulting in cancelled sale.
- Only
unannounced salvage, previous salvage, flood, theft, major damage history
or odometer discrepancy can be arbitrated up to 7 days from date of sale.
- At
times, the need arises for a second opinion, in which case the vehicle
will be rechecked by a third party shop.
The cost of this further inspection, plus applicable transportation
costs will be borne by the owner of the vehicle after arbitration is
complete. Buyer is bound until
3:00 pm of the following Monday.
- The
Auction will not accept the following vehicles for sale:
1.
Vehicles without serial number (VIN) plates.
2.
Vehicles with VIN plates that have been removed or altered
unless reassigned by proper authorities.
All vehicles with an assigned serial number must be announced and sold
under the yellow light.
3.
Unsafe vehicles—to be determined by Auction.
4.
Grey Market cars (not originally manufactured for sale in the
United States) or cars not meeting US standards (including Canadian vehicles)
must Be announced.
5.
Vehicles without clear US titles.
- The
Auction has not verified and makes no representation or guarantees as to
the description, equipment, warranties, or odometer reading on any vehicle
sold or offered for sale. Buyer
assumes the responsibility to verify all of seller’s representations,
warranties, and descriptions and to notify Auction in case of any
discrepancy, no later than one hour from end of sale. Any information placed on the
windshield of a vehicle such as mileage, year, make, model, etc., is for
convenience only and is not a representation, warranty, or condition of
sale.
It shall be the
responsibility of all customers to review the Auction’s rules and arbitration
policies and any revisions thereto, before doing any business at the
Auction. These rules and policies, as
well as any and all revisions, will be posted on the Auction premises. Free copies of the Auction’s rules and
arbitration policies are available at the front counter, dealer registration,
and at the arbitration office.
Customers who do not comply with Auction rules may be barred from doing
business at the Auction.
Offers and Outside Sales
Offers
- Consigned
vehicles must first cross the block before offers will be approved by the
Auction. Vehicles sold
off-the-block will be sold “As-Is” (unless guaranteed by the seller) and
are not rejectable for any reason other than incorrect mileage, frame
damage, or salvage title and off blocks are not final until both buyer and
seller consummate the deal.
- Once
an offer has been made the buyer should consider the offer binding
unless advised to the contrary by the auction within 1 hour of the
sale of vehicle. Sellers must
produce an answer to an offer within 1 hour after sale of
car—Please be available. Financial
Institutions and Fleet Lease must produce an answer within 2 hours.
- Only
accepted offers are arbitratable.
Outside Block
Sales
- The
appropriate sale fees and buyer’s fees are payable to the Auction on any
transaction when contact is made on the Auction premises whether or not
the vehicle is sold on the auction block.
- If
any part of any deal is negotiated and/or consummated on our premises,
full Auction fees must be paid to the Auction. All such sales are “As-Is”.
Sellers
- Please
have your units on the premises early on Sale Day morning, avoiding the
last minute rush. Vehicles which
are not safe to operate will not be run through the auction lanes. Please represent your cars accurately
and fairly. Please be sure each
vehicle has enough gas to be test-driven.
There will be a $5.00 gas charge to any vehicle out of gas.
- Vehicles
with unreadable odometers will not be offered for sale.
- All
cars registered are subject to inspection by the State Police, the Federal
Bureau of Investigation or National Auto Theft Bureau. Please do not bring any cars without
the serial number plate (vehicle identification number).
- Any
unannounced title brand or autocheck announcement discovered after sale of
vehicle, seller is to pay buyer all reasonable expenses with receipts.
- IT
IS THE SELLER’S RESPONSIBILITY TO MAKE SURE THE CORRECT LIGHTS ARE LIT,
THE CORRECT ANNOUNCEMENTS ARE MADE, AND THE CORRECT YEAR AND MILEAGE ARE
ON THE CAR. ADVISE THE AUCTIONEER
IMMEDIATELY IF PROPER LIGHTS ARE NOT LIT AND/OR PROPER ANNOUNCEMENTS HAVE
NOT BEEN MADE.
- Vehicles
on auction premise are at owners risk.
We are not responsible for any loss or damage.
- Auction
will not become involved with additional mileage on returned units.
Buyers
- Please
examine all cars before bidding and be familiar with all announced
conditions of the unit. Cars
should not be road tested until the buyer has the proper sales receipts
for release from the lot. A limit
of 15 minutes for road test.
Please examine the serial number plate model year and the mileage
reading before leaving the sale.
Buyer is responsible for damage during road test. All “As Is” units do not qualify
for a test drive.
- Any
misunderstanding concerning price must be addressed at the block. The vehicle price is not subject to
arbitration.
- Vehicles
must be picked up ASAP—7 days maximum or a charge of $25.00 per day for
storage.
- Representation
of cars. If the car was not
properly represented, file a complaint within 1 hour after end of sale in
the arbitration office and get a decision there before leaving.
- Year
and mileage on windshield is for convenience only and is not to be relied
upon. Please examine all cars
before bidding and be familiar with all announced conditions of the unit. Under any circumstance “flipping of the
coin” will not be tolerated.
- In-transit
plates are available at the front counter for $3.00.
- All
units here by 10:00 am and/or sold will be autochecked for your protection
and any unit 9 model years or newer branded “major damage history” must be
announced. Year change, January 1st.
- We
strongly urge you not to sell or spend money on a car until you receive
the title, as these costs will not be reimbursed by West Central Auto
Auction.
Method of Payment
on Sale Day
- Cash
- Checks—company
or certified, only with prior approval by auction management.
- No
credit cards
- Any
returned check will subject buyer to suspension or termination of trading
privileges at this Auction.
- Buyer
will also be expected to pay all expenses connected with collection of
unpaid items. A $100 charge will
be assessed to any returned check.
- “OK
to Pay” Rules and Regulations
·
You must be a franchised new car dealer.
·
You must be pre-approved through the office.
·
You will receive a credit limit.
·
Any exceptions must be approved through a member of
management.
·
All forms of payment must be in the office on the
Monday following the sale by 5:00 pm.
·
We have the right to take dealers off this option at
any time.
·
Not paying for vehicles without proper arrangements
before leaving the auction are subject to a surcharge.
Titles
Any original title from the USA will be accepted when
accompanied by the documents required for registration in the State of
Iowa. The following titling documents
are not acceptable:
- Duplicate
title applications
- Junk
bills of sale
- Lien
documents, government actions (such as marshal sales not accompanied by
title)
- Foreign
title documents
- Salvage
certificates/bills of sales
- Paperless
title certificates and transfers
- MSO’s
or CO’s
Late Titles
If the Auction has not procured the documents necessary to
transfer title from the Seller, the vehicle may be mediated (not returned) for
no title after 21 days from the date of sale, provided that the Buyer has
notified the arbitration department in advance of their desire to do so. The Auction may then at its discretion,
cancel the sale or take the necessary steps to secure the title. All expenses to obtain the title will be
charged to the seller. Applications for
duplicate titles will not be acceptable to stop the mediation of a no title
vehicle after 21 days. No expenses will
be repaid that are incurred after the vehicle has left the auction
grounds. In all cases, buyer must
return the vehicle in like or better condition than when purchased. Vehicles must be returned within 2 days
instate, and no more than 5 days out of state.
A $50.00 charge will be charged after 30 days. The seller must pay the buyer for transportation costs to the
auction for no title after 30 days.
If the title has not been received after 21 calendar days
and beyond, the buyer has the right to serve a 5 working day notice to
management. At the end of the 5 working
day waiting period, whichever arrives at the auction first (vehicle vs. title)
takes precedence. Both buyer and seller agree to hold WCAA harmless.
The Auction is not responsible for “Fees Due” on bank
repos. Vehicles not announced
with “Fees Due” will be handled on a case-by-case basis. Any fees due after 15 days from sale date
are non-negotiable.
Reserved Number Policy
The reserved number policy at West Central Auto Auction is
as follows:
- Reserved
number requests will be taken from 11:00 am Thursday until 3:00 pm
Wednesday.
- Cancellations
must be made by 5:00 pm Wednesday.
All “No Shows” will be charged $10.00 per number.
- All
reserved numbers are handled on a first call-first serve basis.
- All
unsold vehicles left on our lot from the previous week’s sale will have
priority for numbers for following sale.
- Reserved
numbers good until 10:30 am Thursday.
- Any
vehicle left after 3 consecutive weeks must have a price adjustment to
sell or be removed or a storage fee applies.
